Our Privacy Policy

Last updated 05.06.2024.

Introduction

Finch Q, an application for the Apple Watch developed by Tightwire, Inc. ("we," "us," or "our"), is committed to protecting the privacy of its users ("you"). This Privacy Policy outlines our practices regarding the non-collection and handling of data through our mobile application (the “Application”) and our website.

Acceptance of this Privacy Policy

IF YOU DO NOT AGREE WITH THE TERMS OF THIS PRIVACY POLICY, PLEASE DO NOT ACCESS THE APPLICATION OR WEBSITE.

We reserve the right to make changes to this Privacy Policy at any time for any reason. Changes will be communicated by updating the “Last Updated” date of this Privacy Policy and through in-app notifications or email. Continued use of the Application after such changes constitutes your acceptance of the new terms.

Information We Do Not Collect

We do not collect or store any personal data through the Application. All data related to your use of the Application remains locally on your device or within your iCloud storage, to which we have no access.

Information Related to Emergency Services

Geo-Location Information: With your permission, we may access your device's location services to provide emergency assistance in cases such as falls or serious health incidents. This geo-location information is used solely during the emergency and is shared with your Personal Team, which is selected by you. It's important to note that Finch Q does not send an explicit alert to you if a fall is detected, as fall detection and alerting are managed by your Apple device.

Personal Team Recruitment

When you select someone from your contacts to join your Personal Team, Finch Q sends an SMS/text message to that individual. This message informs them of your request and asks for their permission, as legally required, to receive SMS/text messages. Periodic messages are necessary to keep them informed of any significant changes in your health status. Finch Q records their phone number and opt-in status exclusively to document their response to this request—whether they accept or decline. This practice ensures compliance with applicable laws governing electronic communications.

Email Newsletters

When you sign up to receive email newsletters from our website, we collect and store your email address through our email service provider to send you periodic updates and communications. You can unsubscribe from these newsletters at any time using the unsubscribe link provided in every email we send. Upon unsubscribing, your email address will be removed from our mailing list, and you will no longer receive communications from us.

Security of Your Information

Your data security is primarily provided by the security measures of your device and your iCloud. We encourage you to employ strong security settings and review the security policies of your iCloud to ensure the protection of your personal information.

Compliance with Privacy Laws

This Privacy Policy is designed to comply with the General Data Protection Regulation (GDPR), California Consumer Privacy Act (CCPA), and other relevant privacy laws applicable to regions where our app is available. We ensure that all user data control is maintained solely by you through your device. Deleting the app from your device will remove all associated data. This approach complies with your rights under data protection laws such as GDPR and CCPA.

Children’s Privacy

We verify the age of our users through the date of birth present in the Apple Health data. We do not knowingly collect or engage with data from children under the age of 18.

International Data Transfer

As we do not collect or store your data, there are no international data transfers to be concerned with. Data management and transfer are handled by your device and any third-party services you use.

Effective Date and Notification of Changes

This Privacy Policy is effective as of May 6th, 2024. We will notify you of any changes by updating the "Last Updated" date of this document and through in-app or email notifications. Regular review of this Privacy Policy is encouraged.

Your Rights

As Finch Q does not collect, store, or process any of your data externally, all personal data remains within your control on your device or iCloud. Here are the rights you have in managing your data:

  • Access and Manage: You have full access to all data stored on your device or iCloud through the settings available in your device or iCloud account. You can view and manage this data directly.

  • Uninstallation: Uninstalling the app removes all data associated with it from your device. For complete data deletion, including any backups in iCloud, please follow Apple’s guidelines here and here.

  • Data Processing: All processing of your data occurs locally on your device or through your iCloud based on your settings and permissions. You have control over these processes through your device and iCloud settings.

Third-Party Relationships

We engage with third-party service providers to enhance app functionalities, such as AI analysis and notifications. These services only receive anonymized data, with no ability to identify individual users. All third-party services are vetted to ensure compliance with our strict privacy standards.
